These Terms & Conditions (“Terms”) govern your use of the Miyora Sushi website (miyorasushi.co.uk) and any orders placed with us. By accessing our website or placing an order, you agree to be bound by these Terms.

These Terms comply with the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and other applicable UK legislation.

3. Our Products

3.1 All products are prepared on a strict pre-order basis, made fresh to order in limited quantities to ensure quality and freshness.

3.2 Product images on our website are for illustrative purposes only. Actual products may vary slightly in appearance due to seasonal availability, sourcing, and natural variations in ingredients.

3.3 We reserve the right to substitute ingredients of similar quality if specific items become unavailable, with prior notice where reasonably practicable.

4. Allergen Information & Dietary Requirements

4.1 IMPORTANT: Our products may contain or come into contact with allergens including but not limited to:
– Fish
– Shellfish (including crustaceans and molluscs)
– Soy
– Sesame
– Gluten/Wheat
– Eggs
– Dairy

4.2 Our kitchen is not an allergen-free environment. Cross-contamination may occur.

4.3 Customers with food allergies, intolerances, or specific dietary requirements are solely responsible for assessing the suitability of our products before ordering. If in doubt, please contact us before placing an order.

4.4 Customers with severe allergies are strongly advised against ordering from us.

4.5 We comply with Natasha’s Law (effective from October 2021) regarding allergen labelling for pre-packaged for direct sale (PPDS) food.

5. How to Place an Order

5.1 Orders can be placed through our website (miyorasushi.co.uk) or via WhatsApp.

5.2 An order is confirmed only when we send you a confirmation message or email.

5.3 We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, payment issues, pricing errors, or operational constraints.

6. Pricing & Payment

6.1 All prices are listed in GBP (£) and include applicable VAT where relevant.

6.2 Full payment is required at the time of ordering.

6.3 We accept payments via [Bank Transfer/ Cash].

6.4 In the event of a pricing error, we reserve the right to cancel the order and issue a full refund.

7. Delivery

7.1 We deliver to the address provided by you at the time of order.

7.2 Delivery times provided are estimates and not guaranteed. We are not liable for delays caused by circumstances beyond our control (e.g. traffic, weather).

7.3 Risk of loss and responsibility for the products passes to you upon delivery.

7.4 You are responsible for:
– Providing accurate delivery information
– Ensuring someone is available to receive the order
– Storing products appropriately upon receipt (refrigerated below 5°C)
– Consuming products within the recommended timeframe (we recommend within 4 hours of delivery)

7.5 We are not liable for product deterioration due to improper storage or delayed consumption after delivery.

8. Cancellations & Refunds

8.1 PERISHABLE GOODS NOTICE: Under the Consumer Contracts Regulations 2013, the right to cancel does not apply to perishable goods including sushi and other freshly prepared food items.

8.2 Once an order is confirmed, it cannot be cancelled or amended unless required by UK consumer protection law.

8.3 Refunds may be issued at our discretion in the following circumstances:
– The product is not of satisfactory quality
– The product does not match the description
– The product is not fit for purpose

8.4 To request a refund, please contact us within 24 hours of receiving your order with photographs and a description of the issue.

8.5 Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

9. Limitation of Liability

9.1 Nothing in these Terms limits or excludes our liability for:
– Death or personal injury caused by our negligence
– Fraud or fraudulent misrepresentation
– Any matter for which it would be unlawful to exclude or restrict liability

9.2 Subject to clause 9.1, our total liability for any claim arising under or in connection with these Terms shall not exceed the total value of the order placed.

9.3 We are not liable for:
– Allergic reactions where allergen warnings have been provided
– Improper handling or storage after delivery
– Indirect, special, or consequential losses
– Loss of profit, business, or opportunity

10. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, or supply chain disruptions.

11. Intellectual Property

All content on our website, including images, text, logos, and branding, is the property of Miyora Sushi or our licensors. You may not reproduce, copy, or use our content without prior written permission.

12. Privacy

Your use of our website is also governed by our Privacy Policy, which forms part of these Terms.

13. Changes to These Terms

14. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
